Please read these Terms and Conditions carefully before using our website and services operated by Bangalow Bread Co (“us”, “we”, or “our”). By accessing or using our website and purchasing our products, you agree to be bound by these Terms. If you do not agree to all of these Terms, please do not use our website or services.
Definitions
· “Customer” refers to any person or entity that accesses or purchases products or services from our website.
· “Product” means any cake, baked good, or related item offered for sale on our website.
· “Order” refers to the request placed by the customer for goods and/or services through our website.
· “Website” refers to our online platform through which products and services are offered.
Eligibility
To purchase products from our website, you must be at least 18 years of age or have the involvement of a parent or legal guardian. By placing an order, you confirm that you meet this age requirement and have the legal capacity to enter a binding contract.
Ordering Process
· Orders must be placed via the website by following the guided process and providing accurate and complete information.
· All orders are subject to acceptance and availability. We reserve the right to refuse or cancel orders at our sole discretion, for reasons including but not limited to: product unavailability, errors in product or pricing information, or suspected fraudulent activity.
· Upon placing an order, you will receive an email confirmation with the details of your order. This confirmation does not constitute acceptance of your order but simply acknowledges receipt.
· Acceptance of your order and the completion of the contract between you and us will occur when we dispatch the product(s) to you or otherwise communicate acceptance in writing.
Pricing and Payment
· All prices are listed in AUD $ (Australian dollars) and includes any applicable taxes unless otherwise stated.
· Prices for products may change at any time at our discretion. Prices that appear at the time of purchase will be honoured for your order.
· Payment is required in full at the time of ordering. We accept payment via major credit cards, debit cards, and other payment methods as indicated on our website.
· By submitting payment information, you authorise us to charge the applicable amount to your chosen payment method.
Product Information and Allergies
· We strive to display accurate descriptions and images of our products, but minor variations may occur. Images are for illustrative purposes only.
· Some products may contain allergens such as nuts, gluten, dairy, eggs, or soy. It is your responsibility to review the product descriptions and inform us of any allergies before placing an order. Contact us prior to ordering if you have specific dietary requirements or concerns.
Delivery and Collection
· We DO NOT offer delivery services, as described on our website.
· You must be able to collect your order at our shop front location, at your allotted time.
· We will make every reasonable effort to provide products at the agreed time but cannot guarantee this when it comes to circumstances beyond our control.
· It is your responsibility to provide accurate contact details. We are not liable for incorrect orders resulting from incorrect or incomplete information.
Cancellations
· Once payment has been made your order is confirmed and you have read all terms and conditions.
We do realise that there will be Cancellations due to unforeseen circumstances - however: please give us 7 days’ notice for all cancellations and we will issue you with a CREDIT NOTE to the full amount paid, T&C's Apply. Notice less than 7 days - you will only receive 50% of the total order back as a CREDIT NOTE
· To request a cancellation, please contact us by email or via the website contact form as soon as possible. Cancellations are not confirmed until you receive written confirmation from us.
· We reserve the right to refuse cancellations for orders that are already in production or have items already purchased for the production of the item
Refund Policy
We take pride in the quality and freshness of our cakes and strive to provide every customer with a positive experience. However, if you are not satisfied with your purchase, please refer to the following refund policy:
Eligibility for Refund
· Refund requests must be made within 24 hours of receipt of your order.
· To be eligible, you must provide proof of purchase and a clear description (with photos, if possible) of the issue or problem
· Refunds may be offered in the following cases:
· The product received is incorrect, damaged, or does not match the description.
· The order was not supplied within the agreed timeframe due to an error on our part.
No refunds will be issued for:
Change of mind or a wrong decision
Failure to collect an order at the agreed time, this includes failing to collect within our store business hours.
Orders with incorrect details provided by the customer.
Allergen-related concerns where no prior notice was provided.
Refund Process
· To initiate a refund, please contact us with your order number, details of the issue, and supporting photos (if applicable).
· We will investigate the issue and notify you of the outcome within 3 business days.
· If a refund is approved, it will be processed to your original method of payment within 5-10 business days. Alternatively, you may be offered store credit or a replacement product, at our discretion.
Custom and Special Orders
· Custom cakes and made-to-order items are non-refundable unless the product is incorrect, damaged, or does not meet the agreed specifications.
· Please review your custom order details carefully before confirming, as changes may not be possible once production has begun.
Intellectual Property
· All content on this website, including text, images, logos, and product designs, is the property of Bangalow Bread Co or its licensors and is protected by copyright, trademark, and other intellectual property laws.
· You may not use, reproduce, or distribute any content from this website without our express written permission.
Limitation of Liability
· To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of data, or personal injury arising out of the use or inability to use our products or website.
· Our total liability for any claim arising out of or relating to these Terms or our products and services shall not exceed the amount paid by you for the relevant order.
Privacy Policy
When placing an order with us, your details are not reproduced in any way or passed on to anyone. Any information we collect from you is for the sole purpose of processing your order and will not be tendered, sold, exchanged, or otherwise disclosed to anyone unless required by law. We do not store customer account details, and we pride ourselves on discretion.
Modifications to Terms
· We reserve the right to update or change these Terms at any time. Any changes will become effective immediately upon posting on our website.
· Your continued use of the website after changes are posted constitutes acceptance of the revised Terms.
